Terms and Conditions

These Terms apply globally, with UK consumer protections (Consumer Rights Act 2015, Consumer Contracts Regulations 2013, PECR/UK GDPR) applied as the baseline standard for all customers, regardless of location.

2. Pre-Contract Information (Consumer Contracts Regulations 2013)
- Main service characteristics: Game server hosting and related services (as described on the product pages/order flow).
- Total price and taxes: Prices displayed in USD by default (excluding VAT). Customers may select payment in USD, CAD, EUR, AUD, or GBP. VAT is added at checkout for UK customers where applicable; other taxes/fees are shown before checkout confirmation.
- Payment methods: PayPal, Stripe, major credit cards.
- Contract duration / renewal: Month-to-month unless stated otherwise at order. Auto-renews each period until cancelled.
- Minimum term: None unless explicitly stated on the product at checkout.
- Cancellation right: 14-day cooling-off period for consumers (applied globally). See Section 6.
- Effects of early performance: If you ask us to start service within the cooling-off period, you may owe a proportionate amount for the period used before cancellation.

- Language: Contract offered in English.

3. Service Description and Quality
GameForge provides game server hosting services as described on our website/order forms. We will provide services with reasonable care and skill (Consumer Rights Act 2015). We may modify or improve services; material negative changes will be notified at least 30 days in advance where practicable.
4. Acceptable Use
You must comply with all applicable laws and our Acceptable Use Policy. Breaches may lead to suspension or termination under Section 9, subject to proportionality and notice.
5. Payment and Billing
- Services are billed in advance on your selected billing cycle.
- Failure to pay: we may suspend after notice and a reasonable cure period (typically 14 days), then terminate if unpaid.
- Invoices are provided electronically. Prices exclude VAT by default; VAT is added at checkout for UK customers where applicable. For UK business customers, reverse charge may apply (where relevant).
6. Cancellations and Refunds (Global 14-Day Cooling-Off)
6.1 Cooling-Off Right
- Consumers may cancel within 14 days of contract conclusion without giving a reason (applies globally as our minimum standard).
- To cancel, email [email protected] or use the account cancellation flow. We will confirm receipt.
6.2 Early Performance
- If you request activation during the cooling-off period, you will pay a proportionate amount for services provided until cancellation. If service has been fully performed (e.g., one-time setup completed with your express request), the right to cancel may be lost for that service.
6.3 Refund Timelines
- Refunds are issued within 14 days of receiving your cancellation notice (or of proof of return where physical goods are involved—none expected here). Refunds use the original payment method where possible.
6.4 After the Cooling-Off Period
- Monthly terms: cancel anytime; service continues to period end; no further renewal charges.
- Longer terms (if offered): specify at purchase; refunds/proration only if we materially breach or as required by law.
6.5 Statutory Rights
- These rights are in addition to any statutory rights you have under the Consumer Rights Act 2015 and cannot be excluded.
7. Data and Backups
- You are responsible for maintaining your own backups.
- If your plan includes backups, we will exercise reasonable care and skill in providing them, but you should maintain independent backups.
- We are not liable for data loss caused by your failure to maintain backups. We remain liable for data loss caused by our negligence or failure to perform contracted backup services.
8. Limitation of Liability
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot be limited/excluded by law (including statutory rights under the Consumer Rights Act 2015).
For consumers: We are responsible for foreseeable loss and damage caused by our breach. Your statutory rights are not affected.
For business customers: To the fullest extent permitted by law, we exclude liability for indirect or consequential loss. Our total liability is capped at the fees you paid in the 12 months preceding the claim, except for the non-excludable items above.
9. Suspension and Termination
- For cause: We may suspend/terminate for material breach (including AUP) or non-payment after notice and a reasonable opportunity to remedy (typically 7–14 days). Immediate action may be taken for illegal activity, security threats, or court orders.
- Without cause: We may terminate with 60 days' notice and will refund any unused, prepaid amounts pro rata.
- By you: You may terminate at any time via account tools or by notice; see Section 6 for refund rules.
- We will act proportionately and provide reasons for enforcement decisions. Appeals are available via [email protected].
10. Governing Law and Disputes
- Governing law: Laws of England and Wales.
- Consumers may bring proceedings in the courts of their habitual residence where mandatory consumer protection laws allow.
- We encourage escalation to [email protected]; if unresolved, we will engage in reasonable alternative dispute resolution where required.
11. Electronic Contracting (E-Commerce Regulations)
Contract formation steps: (1) select services, (2) review order and pricing, (3) confirm acceptance of these Terms and policies, (4) submit payment, (5) contract concludes when we send order confirmation. You may correct input errors before submission using the checkout edits; after submission, contact support within 24 hours to correct mistakes. We store contract terms and order details in your account dashboard.
